THESE TERMS AND CONDITIONS ARE BINDING AND ENFORCEABLE AGAINST ALL USERS WHO ACCESS OR USE THE MASIBAMBISANE STATIONERY WEBSITE (“WEBSITE”) IN TERMS OF SECTION 11(3) OF THE ELECTRONIC COMMUNICATIONS AND TRANSACTIONS ACT 25 OF 2002 (“ECT ACT”).

IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU ARE REQUIRED TO EXIT THE WEBSITE IMMEDIATELY. CONTINUED USE OF THIS WEBSITE WILL BE DEEMED TO CONSTITUTE ACCEPTANCE OF THESE TERMS.

Should you be dissatisfied with your purchase, and subject to the conditions outlined below, you may return eligible products for a repair, replacement, or refund.

1. Definitions & Interpretation

  1. Catalogue – The list of products and services available from Masibambisane Stationery.
  2. Consumer – A natural person using goods or services for personal (non-commercial) use, as defined under the Consumer Protection Act 68 of 2008 (CPA).
  3. Masibambisane Stationery / We / Us – Masibambisane Stationery (Pty) Ltd.
  4. Force Majeure – Circumstances beyond our control, such as acts of God, fire, flood, government actions, labour disputes, and supply chain interruptions.
  5. Website – The official website of Masibambisane Stationery, including all associated content and linked platforms owned by us.
  6. User / You – Any person who accesses or uses this Website, regardless of the extent of use.
  7. Singular / Plural – Words denoting one include the plural and vice versa.
  8. Hyperlinks – Any invalid or broken hyperlink in this document does not affect the interpretation of the remaining terms.

2. Orders

  1. Best Value & Quick Delivery
    • We aim to provide excellent value and efficient delivery. If you wish to cancel an order, please notify us immediately. Cancellations from business clients may not be accepted if dispatch is already in progress.
  2. Consumer Cancellations
    • Consumers may cancel orders under the ECT Act or the CPA. This does not affect your right to reject faulty goods.
  3. Terms of Sale
    • All purchases are subject exclusively to these terms, regardless of any other terms communicated by you.
  4. Order Acceptance
    • Orders are subject to availability. We reserve the right to accept or reject any order at our discretion.
  5. Customer Responsibilities
    • Ensure all order information is accurate. You are responsible for all orders placed using your login credentials.
    • Only use authorised payment methods. Sufficient funds must be available, and payment information may be validated before your order is processed.
  6. Product-Specific Requirements
    • TV Licences: For TV purchases, a valid TV licence number and ID of the licence holder are mandatory. If not provided within 7 days of request, we reserve the right to cancel the order and recover any associated costs.
    • Microsoft SPLA Products (if applicable): Monthly usage reports must be submitted by the 10th. Zero-usage will be reported if no data is provided.
  7. Call Monitoring
    • Phone calls and electronic communications may be monitored or recorded for quality control and staff training purposes.

3. Delivery, Ownership & Risk

  1. Delivery Timelines
    • We strive to dispatch orders on time but are not liable for delays caused by third parties (e.g., couriers or manufacturers). You will be notified of any unforeseen delays.
  2. Delivery Failure & Cancellations
    • If goods are not delivered within 30 days, and you are a Consumer, you may cancel the order in writing for a full refund—provided cancellation occurs before delivery or a readiness notice is issued.
  3. Delivery Days
    • Deliveries are made on business days. Please ensure someone is available to receive the goods.
  4. Risk Transfer
    • Risk passes to you once the goods are delivered to your specified address.
  5. Ownership Transfer
    • Ownership passes to you only upon receipt of full payment.
  6. Failed Deliveries
    • If you are unavailable for delivery, we may:
      • Store and insure the goods at your expense.
      • Attempt redelivery (additional costs may apply).
      • Resell the items and refund any surplus or charge for any shortfall.
  7. Proof of Delivery
    • Proof of delivery is available on request within three (3) months of dispatch.
  8. Receipt Confirmation
    • Upon delivery, you will be required to sign a delivery note or invoice. You must confirm the number of packages received and record any damage or discrepancies.
  9. Partial Deliveries
    • Orders may be shipped in multiple deliveries and invoiced separately unless otherwise agreed in writing.
